Staybothy is a direct-booking platform for independent self-catering accommodation, operated by Binared Ltd ("Staybothy", "we", "us"). These Terms govern your use of the Staybothy website and services. By using the site you agree to them.
1. Who we are
Staybothy is a service of Binared Ltd, a company registered in the United Kingdom (company number [COMPANY NUMBER]; registered office [REGISTERED ADDRESS]). Binared Ltd is registered for VAT under number [VAT NUMBER]. You can contact us at [email protected].
2. What Staybothy does — and does not — do
Staybothy provides the technology that lets independent hosts publish a booking page and take bookings directly, and lets guests find and book those properties. Each booking is a contract between the guest and the host's own business, not with Staybothy. We are not the owner, manager, agent or insurer of any property, and we are not a party to the booking contract. The host is responsible for their property, its description, its availability, the stay itself, and their own cancellation and refund policy, which is shown before the guest pays.
3. Bookings, payments and refunds
Payments are processed by Stripe. Where shown, a deposit is taken at the time of booking and the balance is charged automatically before arrival; the exact amounts, schedule and cancellation terms are set by the host and displayed at checkout. Refunds and cancellations are governed by the host's stated policy for that property. Staybothy does not hold guest funds as principal and is not responsible for the host's performance of the booking.
4. Host accounts and fees
Hosts may create an account to list a property. A free plan is available; paid plans and any commission on direct bookings are described on our pricing pages. All subscription and commission fees are stated exclusive of VAT; VAT is added where applicable. Hosts are responsible for the accuracy and legality of their listings, for holding any licence required to let their property (including, in Scotland, a short-term let licence), and for meeting their own tax and regulatory obligations.
5. Acceptable use
You agree not to misuse the site: no unlawful, fraudulent, infringing or harmful activity; no attempts to disrupt, probe or gain unauthorised access to the service; and no use of the site to send spam or to scrape data without permission. We may suspend or remove accounts or content that breach these Terms.
6. Intellectual property
The Staybothy name, site and software are owned by Binared Ltd. Hosts retain ownership of the content they upload and grant Staybothy a licence to host and display it for the purpose of operating the service.
7. Liability
Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or for fraud). Subject to that, Staybothy is not liable for the acts or omissions of hosts or guests, for the condition or safety of any property, or for indirect or consequential loss. Our total liability to you in connection with the service is limited to the fees you have paid to us in the 12 months before the claim.
8. Changes
We may update these Terms from time to time. The version on this page, with the date above, is the one that applies.
9. Governing law
These Terms and any dispute arising from them are governed by the laws of [SCOTLAND / ENGLAND & WALES — confirm], and the courts of that jurisdiction have exclusive jurisdiction.
